ADOPTS
- Includes personal and commercial use
- After purchase you are free to change the design to your liking, however always credit me for the original design
- You can resell, retrade or gift/do giveaways, just dont sell it for more than you bought it for (except it comes with additional art or any other form of additional worth)
- If you are Blacklisted you cannot purchase any design made by me
- If you have purchased a design by me you can not under any circumstance give it to someone being blacklisted or you will be blacklisted yourself
- No Backing Out!
- No Refunds!
- No holds except otherwhise discussed BEFOREHAND
- Payment via Paypal or Ko-fi within 24hours after winning the auction/claiming the design!
- Do not bid/claim if you dont have the money on hand
- By bidding/claiming you agree to my ToS
- If you violate my ToS I will blacklist you, this wont necessarily be with a warning
1. General & Process
Personal & Hobby Status: This shop is operated as a private hobby/non-profit activity. Communication will be done via VGen Messages, if not discussed otherwise.
Custom & Premade Designs: I offer custom commissioned artwork as well as occasional, unique pre-made designs (Adoptables). All pre-made designs are strictly one-of-a-kind (1-of-1) and will never be resold to multiple buyers.
Right of Refusal: I reserve the right to decline any commission request without giving a reason.
Deadlines: Delivery times are estimates. I will communicate any delays actively.
Other:
I have the right to post any and/or all artworks on other social media(s) and for portfolio usage. If you do not want me to share or post the finalized art piece, inform me beforehand.
Do not heavily edit my work without my permission. Small things such as color shifting, background color changes, and cropping, are permitted.
My commissions are not traditionally first-come-first-serve (FCFS). I draw what I believe I will do the best at when there is great demand.
I do not draw Gore, NSFW or "risque" art.
Do not ask me to change my artstyle for you, with accepting my terms you are also accepting my artstyle.2. Payment & Refunds
Payment: All payments must be made in full through VGen.
Refund Policy: No refunds will be issued once the final artwork has been delivered. If you cancel before the sketching phase, a 100% refund is granted.3. Usage & Commercial Rights (No Extra Fee)
Full Rights Included: All commissions include full commercial and personal usage rights at no extra cost, subject to the strict restrictions in Section 4 or if stated otherwise in the request form (e.g. YCH commissions may not come with full commercial rights if the base artist doesnt allow)
Allowed Uses: You are allowed to use the artwork for streaming (Twitch, YouTube, VTubing), merchandise production, promotion, and monetization.
Credit: Credit is always appreciated (Art by Vaniha or link to any Social media)4. STRICT RESTRICTIONS (No AI / No NFT)
No AI Usage: You are strictly PROHIBITED from using my artwork, sketches, or progress files for AI (Artificial Intelligence) training, machine learning datasets, generative AI models, or any similar technology.
No NFT / Blockchain: Under no circumstances may my artwork be used for NFTs (Non-Fungible Tokens), crypto-art, blockchain projects, or any form of digital asset speculation.
Copyright Infringement: Any violation of these restrictions will immediately revoke all commercial and personal usage rights, and legal action may be taken.5. Revisions & Changes
Sketch Phase: You can ask for major revisions during the sketch phase for free.
Final Phase: Only minor color adjustments can be made to the final piece. Major structural changes after approval of the sketch will be denied.
Revisions for Skeb type: Revisions are not available, however exceptions can be made for changes that are due to my mistakes (e.g. wrong colours, wrong traits).6. Deadlines & Delivery
Do not commission me expecting a fast and/or rushed art piece. The exprected turnaround time is stated in the request form. If there are deadline(s), I expect them to be at least 1 week after ordering.I have a full-time job so I have to get commissions done in my freetime and I don't often get to control how much freetime I have. Only commission me if you are willing to wait, but I will still try to work as fast as possible!7. Liability Disclaimer
"As-Is" Delivery: The artwork is provided "as-is". I am a hobby artist and do not guarantee specific commercial success or technical compatibility beyond standard image formats.
Third-Party Rights: You guarantee that any references or characters you provide do not infringe on third-party copyrights. I am not liable for any copyright disputes caused by materials you provided.
Liability Cap: To the maximum extent permitted by law, my liability for any issues arising from the use of the artwork is limited to the amount paid for the commission.8. Miscellaneous
If you commission me to draw something that I have expressed that I am either simply not good at and/or not used to drawing, and are unhappy with the result, I don't expect to take responsibility for this.
